LIABILITY WAIVER & RENTAL AGREEMENT

(Fishing Equipment Rental Services)
 

1. ASSUMPTION OF RISK

The Renter acknowledges that surf fishing and beach-based activities involve inherent risks including, but not limited to: ocean conditions, weather changes, tides, sand terrain, wildlife, equipment handling, and physical activity near water.

The Renter voluntarily assumes all risks of injury, death, or property damage arising from participation in the use of rental equipment.

2. RELEASE OF LIABILITY

The Renter, on behalf of themselves, heirs, and assigns, hereby releases and agrees not to hold liable Reel It In Rentals, LLC, its owners, employees, agents, or affiliates for any injury, death, loss, or property damage arising from the use or misuse of rental equipment, whether caused by negligence or otherwise to the fullest extent permitted by Florida law.

3. INDEMNIFICATION

The Renter agrees to indemnify and hold harmless Reel It In Rentals, LLC from any claims, damages, losses, or expenses (including attorney fees) arising from the use of rented equipment or participation in related activities.

4. EQUIPMENT RESPONSIBILITY

The Renter accepts full responsibility for all rented equipment during the rental period and agrees to pay the $200 security deposit for any loss, theft, damage, or misuse beyond normal wear and tear, including replacement cost and any associated loss of rental income.

5. EQUIPMENT INSPECTION & USE

The Renter agrees to inspect all equipment upon delivery and will immediately discontinue use if any defect or safety concern is identified. The Renter agrees to notify Reel It In Rentals, LLC promptly of any issues.

6. NO WARRANTIES

All equipment is provided “as-is” with no warranties, expressed or implied, including but not limited to fitness for a particular purpose.

7. PROPER USE AGREEMENT

The Renter agrees to use all equipment responsibly and within its intended purpose. Any damage caused by misuse, improper handling, or failure to follow instructions is the responsibility of the Renter.

8. ACKNOWLEDGMENT

By booking, paying for, receiving, or using rental equipment, the Renter confirms they have read, understood, and agree to all terms of this Liability Waiver & Rental Agreement.
